GENERAL TERMS AND CONDITIONS

1. Introductory provisions 

These General Terms and Conditions (hereinafter "GTC") govern the legal relationships between CRYSTAL KAM, s.r.o. as the seller and buyers, who may be natural persons – consumers, as well as natural persons – entrepreneurs and legal entities, who conclude a purchase contract through the e-shop at www.crystalkam.sk. Special protection under Act No. 108/2024 Coll. on consumer protection applies exclusively to buyers – natural persons who do not act within their business activity. These GTC are binding for all buyers regardless of their legal form, while individual provisions apply according to the buyer's legal status. The contractual language is Slovak. The seller reserves the right to change the GTC.

2. User account 

The buyer is entitled to create a user account on the seller's website to simplify the ordering process. When registering, the buyer is obliged to provide true, current and complete information. Access to the user account is secured by a unique combination of username and password, and the buyer is fully responsible for keeping these credentials confidential and for all actions performed via the account. The seller is entitled to deactivate or cancel the buyer's user account in order to protect its rights and legitimate interests, especially if the buyer does not use the account for a long time, breaches these GTC, or the e-shop operation is terminated. The seller does not guarantee uninterrupted availability or error-free functioning of the user account and reserves the right to temporarily suspend access for maintenance or technical reasons.

3. Conclusion of the purchase contract 

The publication of goods and their price and descriptive information on the website www.crystalkam.com does not constitute a legally binding offer to conclude a contract under Act No. 40/1964 Coll. Civil Code, but only an invitation for the buyer to submit an offer. The binding offer to conclude a purchase contract is the buyer's order made through the e-shop. The purchase contract is concluded at the moment the seller expressly confirms the order. The seller reserves the right to confirm the order additionally, especially if the nature of the order or availability of goods requires it.

4. Price and payment terms 

Prices of goods listed on the seller's website are final and include value added tax at the statutory rate applicable at the time of order. Unless otherwise agreed, the purchase price is due upon conclusion of the purchase contract. The seller reserves the right to require payment of the full purchase price in advance, especially for specific or customized orders. The tax document (invoice) is sent to the buyer exclusively in electronic form to the email address specified in the order, no later than seven days from the conclusion of the contract or payment, whichever occurs later.

The e-shop operator does not have access to your payment card data or internet banking credentials. 5. Withdrawal from the contract 

The buyer who is a consumer under Act No. 108/2024 Coll. on consumer protection is entitled to withdraw from the purchase contract without giving a reason within 14 calendar days from the day of receipt of the goods, in accordance with § 19 et seq. of this Act. The right of withdrawal may be exercised by an unequivocal statement addressed to the seller, either in writing or electronically to the email address listed in these GTC. This right does not apply to goods made to the consumer's specifications, goods subject to rapid deterioration, or goods which, for health or hygiene reasons, are not suitable for return and whose packaging was broken after delivery. In case of valid withdrawal, the buyer must return the goods without undue delay, no later than 14 days from the day of exercising the right of withdrawal, together with all related items (e.g. gifts or other benefits). The seller shall refund all payments received, including delivery costs (except additional costs resulting from the buyer's chosen delivery method not offered by the seller), in the same manner used in the original transaction, no later than 14 days from receipt of the withdrawal notice. However, the seller is not obliged to refund payments before the returned goods are received or the buyer proves that the goods were sent back, whichever occurs first.

6. Transport and delivery 

The buyer is obliged to check the quantity, quality and integrity of the packaging upon delivery. If the packaging shows signs of mechanical damage or other unauthorized interference, the buyer is advised not to accept the shipment and to inform the seller immediately. By accepting the shipment, the buyer declares that it was delivered in apparently undamaged condition, unless proven otherwise.

7. Rights from defective performance 

The buyer has the right to claim liability for defects under § 621 et seq. of Act No. 40/1964 Coll. Civil Code. The warranty period for consumer goods is 24 months from the date of receipt. The complaint may be submitted in writing or by email. The seller may issue a separate complaints procedure for handling complaints.

8. Rights and obligations of the parties 

The seller conducts its business activity as a limited liability company registered in the Commercial Register of the District Court Trenčín, section Sro, file no. 21059/R, in accordance with the laws of the Slovak Republic. The buyer is obliged to provide true, complete and current information when placing an order. The buyer undertakes not to use the seller's website in a manner that could jeopardize its proper functioning, compromise security or damage the seller's reputation. Any legal disputes arising in connection with the purchase contract or use of this website shall be governed exclusively by Slovak law and resolved by the competent courts of the Slovak Republic.

9. Protection of personal data 

Processing of personal data is carried out in accordance with Regulation (EU) 2016/679 (GDPR) and Act No. 18/2018 Coll. on the protection of personal data. The controller of personal data is CRYSTAL KAM, s.r.o., with its registered office at Valaská Belá 85, 972 28 Valaská Belá, email: info@crystalkam.sk, web: www.crystalkam.com. The data subject has in particular the right to access personal data, to rectification, erasure, restriction of processing, data portability, as well as the right to object to processing and to lodge a complaint with the Office for Personal Data Protection of the Slovak Republic. Personal data are stored for 10 years from their provision or for the duration of the purpose for which they were obtained, or until withdrawal of consent if consent is the legal basis for processing.

10. Cookies and marketing communications 

To ensure proper functioning of the website and for traffic analysis and marketing, the seller's website uses cookies. Cookies are stored based on the visitor's consent, which can be withdrawn at any time via browser settings or by clicking the relevant link in the website footer. Marketing communications (e.g. newsletters) are sent exclusively on the basis of prior consent in accordance with Act No. 452/2021 Coll. on electronic communications. Unsubscribing is possible at any time free of charge by the method stated in each delivered email.

11. Delivery of communications 

Communication between the parties in connection with performance of the contract is carried out primarily via email to the address specified in the buyer's order or to the seller's email address listed in these GTC. Unless otherwise agreed, electronic delivery is preferred and is deemed effective the day after sending, unless proven otherwise.

12. Final provisions 

These GTC are governed by and interpreted according to the laws of the Slovak Republic. Any invalidity or unenforceability of any provision does not affect the validity and effectiveness of the remaining provisions, which remain in force. Contracts concluded through the e-shop are stored electronically solely for processing and archiving purposes and are not made available to third parties except as required by law.
